Specifics — Free Enterprise, Specifications And Rights

Kevin A. Sensenig | September 21, 2012

Free Enterprise

Small businesses: Family or individuals or leaders and teams working together toward product, service, or expression.

Corporations: Another expression of “to work with others”.

Specification And Rights

The 13th Amendment was stated as a specification or directive to society, the verb and power set to Congress.  This is a problem that persists to this day.  The 13th Amendment could have been written, “The right of the people to be free of slavery or involuntary servitude shall not be denied, by anyone.  This right is available to all individuals, both free and slave; and all are now free, and retain this right.”

This leaves the right to be picked up or enforced or acknowledged or worked out by any group or individual, including individuals, groups, mayors, judges, townships, courts, states, governors, legislatures, Congress, and the President.  (To pick up or enforce a right takes a different hue than to enforce a law.)  It also places the emphasis on _rights_, with the appeal to religion and philosophy and everyday expression; and to the notion of “innate”.

The 13th Amendment currently reads: “Section 1.  Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.  Section 2.  Congress shall have power to enforce this article by appropriate legislation.”
