ObamaCare Problematic Theory

Several Basic Features Of National Socialism

Kevin A. Sensenig | July 16, 2014 | Updated 2014-08-26

The basic features, 4 of them, are as follows.

1.  The (without natural limit) ability to regulate anything touching "economic activity that has significant effect on interstate Commerce" ... and with the "aggregate" theorem, this means that you can layer (markets) and bin (individuals) in just about any way thinkable — and regulate and specify.

2.  The specification of... product, company revenue and expenditure, access point to market, internal pay structure, and price controls.

3.  The provision of "essentials" for the individual, not in terms of currency (that one can deposit into a bank account and later withdraw to spend on what one wants, quite outside the purview of one's employer or manager or government) but in terms of product.  It almost resembles a barter, but this is not quite it.  Because it is, instead of the payment in currency, the product itself, the national government then has the jurisdiction "in looking out for the people" to regulate, specify, determine the price point of, fix the market access point of, etc., this product or essential.

4.  A fascination with the management layer.  In the ObamaCare instance, national socialism spreads all of the entities, function, processes, and product on the floor and then picks and selects this and that to look at and review and manage.  They then bring all their own (self-perceived or real) intelligence to each and every entity, function, process, and product — and the economic function thereof also.  (See the ObamaCare Chart that the Republicans put together I think it was in 2010 or before.)  This instead of the entity type nature of the company or corporation, in which intelligence is directed from center, to product, within clear market grasp.  (This does not always work out perfectly, but it’s the idealization and the model, the role and function, the structure and means.)  Each type of role within each entity-corporation is responsible to both those other roles and types within the company, to its customers, and to state regulation or definition (that is, there’s function, balance, and responsibility).  But it’s not “everything spread out on the floor, to be picked apart and managed” by a flat-line of management and overview, a layer of national government.

The ObamaCare Chart

It was Rep. Pitts (R-PA) who on Fox News in 2010 presented this chart, that Republicans had put together, the ObamaCare Chart; and I'm studying it now with more specific interest.

The Supreme Court Arguments

Day 1 (Monday, March 26, 2012) — Archived here: 11-398-Monday.pdf

Day 2 (Tuesday, March 27, 2012) — Archived here: 11-398-Tuesday.pdf

It’s a significant part of the Tuesday argument (the Verrilli argument) that I have considered in my papers so far (as of 2014-08-26).  I haven’t yet considered the Monday argument (as of 2014-08-26).
